Mrs. Espinosa-Sanchez was a 31 year-old, single mother of five children (ages nine, seven, six, five, and one) when she was given a 15-year sentence in 2002. At the time of her arrest, she was driving her vehicle on Interstate 10 near McAllen, Texas during the early morning hours of September 17, 2002. Due to the late hour, Mrs. Espinosa-Sanchez did not see the lane marker for her lane, veered into the next lane, and struck three vehicles in an adjacent lane. A former teacher, she had at least three prior arrests, including one for driving under the influence in 1994. She was the sole caregiver for her children at the time of the accident. Mrs. Espinosa-Sanchez was arrested for a third time the day before her sentencing for driving under the influence, and was released on her own recognizance.
While the defendant was in the county jail and awaiting trial, Mrs. Espinosa-Sanchez volunteered in the jail's domestic abuse unit, where she counseled women accused of domestic abuse against going to the sheriff's office to file a domestic abuse charge. This at least partially prompted the prosecutor to bring the domestic violence charge against the defendant.
The defendant originally deferred prosecution by entering a plea of no contest in district court. Although we could not find any evidence in the record that a deferred adjudication for a conviction for a felony drug charge was ever revoked, we hoped to find such evidence to show that, at some point, the defendant was convicted of a felony drug charge, but was allowed, on some unknown or unexplained basis, to get back on the streets. Despite extensive efforts to find a copy of Mrs. Espinosa's probation, however, we found nothing. At the same time, it was obvious, just by looking at the record, that a misdemeanor conviction for driving under the influence was considered by the government to be much more serious than a deferred adjudication for a drug felony charge. d2c66b5586
